CONDUCT EXPECTED OF ALL PERSONS ON OR USING SCHOOL DISTRICT PROPERTY

BOARD POLICY 1350

The Board recognizes that respect for school employees and students and enforcement of rules and regulations must prevail if the maximum educational benefits are to be derived by pupils. School employees and students must not be subject to threats, insults, or abuse by patrons of the schools, other persons, or students. School shall be maintained as a safe and positive learning environment for students.

As required by State law, the Board adopts the following rules and regulations.

  1. No person using or upon school district property for any purpose shall engage in:

    1. Any conduct intended to obstruct, disrupt, or interfere with teaching, learning, research, service, administrative or disciplinary functions, or any activity sponsored or approved by the Board.

    2. Physical abuse of or threat of harm to any person on school district owned or controlled property or at school district sponsored or supervised functions.

    3. Threat of damage or damage to property of the school district, regardless of the location, or property of a member of the community or a visitor to the school, when such property is located on school district controlled premises.

    4. Forceful or unauthorized entry to or occupation of school district facilities, including both buildings and grounds.

    5. Unlawful use, possession, distribution or sale of drugs, alcohol, and other illegal contraband on school district property, or within 300 feet of school district property, or at school-sponsored functions.

    6. Conduct or speech which violates commonly accepted standards of the school district and which, under the circumstances, has no redeeming social value.

    7. Failure to comply with the lawful directions of school district officials or of school district security officers or any other law enforcement officers acting in performance of their duties, and failure to identify one's self to such officials or officers when lawfully requested to do so.

    8. Knowing violation of school district rules and regulations. Proof that an alleged violator has a reasonable opportunity to become aware of such rules and regulations shall be sufficient proof that the violation was done knowingly.

    9. Any conduct constituting a breach of any federal, state or city law or duly-adopted regulation of the Board.

    10. With or without a State concealed weapons permit, carrying or possessing a weapon, dangerous instrument or explosive on school grounds or other District premises unless the person is a peace officer or has obtained specific written authorization from the school administrator. Any deadly weapon, dangerous instrument or explosive used, displayed or possessed by a person in violation of this rule shall be forfeited and sold, destroyed, or otherwise disposed of, as authorized by A.R.S. §13-2911(27).

  2. No person shall visit or audit a classroom or other school activity, nor shall any person come upon or remain upon school premises during school hours, without the approval of the Superintendent or his authorized representative. No persons shall conduct or attempt to conduct any activity on school premises without prior approval of the Principal or his authorized representative.

  3. No person shall commit any act that interferes with or disrupts the lawful use of school property or shall enter upon school property for the purpose of committing such an act.

  4. Any member of the general public considered by the Superintendent of the school district or his designee to be in violation of these rules shall be instructed to leave the property of the school district and shall be advised that the police will be called if the person refuses to leave. If the person persists in the disruptive conduct or refuses to leave, the Superintendent or designee shall call the city police or county sheriff for assistance. Failure to obey said instruction may subject the person to criminal proceedings pursuant to A.R.S. §13-2911, or any other applicable statute, civil or criminal.

  5. The Superintendent is authorized to designate the site Principal or designee as the person with authority at each school site to enforce this policy and instruct persons in violation of the policy to leave the property.

  6. Appropriate notice of this policy shall be posted on each school site.

  7. In addition to any criminal or civil court prosecution, any District employee shall be appropriately disciplined under District policy for violation of these rules.

  8. In addition to any criminal or civil court prosecution, any student shall be appropriately disciplined under policies numbers 5060 and 5061, as applicable, for violation of these rules.
