BOARD POLICY 4002

  1. It is the policy of Tucson Unified School District to actively pursue its affirmative commitment to ensure equal employment opportunity for all employees and applicants for employment. Affirmative action to ensure that applicants are employed, and that employees are treated during employment, without regard to their race, color, national origin, religion, age, disability, sex or sexual orientation shall include, but not be limited to, the following.
    1. Recruiting, hiring, training, promoting, and terminating persons in all job titles without regard to race, color, national origin, religion, age, disability, sex or sexual orientation.
    2. Basing decisions on employment so as to further the principle of equal employment opportunity; all hiring decisions shall be based on an individual's actual qualifications.
    3. Ensuring that promotion decisions are in accord with principles of equal employment opportunity by imposing only valid requirements for promotional opportunities.
    4. Ensuring that all personnel actions such as compensation, benefits, transfers, layoffs, return from layoff, District-sponsored training, education assistance, and other programs will be administered without regard to race, color, national origin, religion, age, disability, sex or sexual orientation.
  2. Tucson Unified School District shall make known by public means that equal employment opportunities are available on the basis of individual merit and will actively encourage all persons to seek employment and to strive for advancement on this basis.
  3. It is the goal of Tucson Unified School District to achieve a reasonable work force mixture of minorities and women at all levels of employment. To this end, periodic studies, including work force, availability, and utilization analyses will be conducted to determine what measures are needed to accomplish this commitment and maintain conformance with the equal opportunity policy.
  4. Responsibility for the implementation of the Affirmative Action Plan rests with each manager and supervisor associated with hiring, developing, or promoting personnel to fully cooperate and assist in the achievement of equal opportunity goals.
  5. It is the intent of the Governing Board that this policy shall be enforced the same as any other policy of the Board in all building and administrative units throughout the District. Any overt or covert attempt to thwart or to circumvent this policy shall be grounds for disciplinary action as determined by the Superintendent and the Governing Board.

The following policy statement shall appear in the Tucson Unified School District pamphlet entitled Information on Nondiscrimination Legislation and Grievance Procedure (posted at each site).

The Tucson Unified School District is taking affirmative steps to ensure that practices at every level of the District's operation are nondiscriminatory.

In accordance with Title VI and Title VII of the Civil Rights Act of 1964 as amended by the Civil Rights Act of 1991, Title IX of the Education Amendments of 1972, Section 504 of the Rehabilitation Act of 1973, the Equal Employment Opportunity Act of 1972, the Americans With Disabilities Act of 1990, and other nondiscrimination laws and regulations, Tucson Unified School District does not discriminate in educational programs or in employment on the basis of race, color, national origin, religion, age, disability, sex or sexual orientation (age applies only to employment).
